Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Ship AI (“Ship AI,” “we,” “us,” or “our”) governing your access to and use of the Ship AI iOS app, our website at tryshipai.com, and any related services that link to these Terms (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Section 11 describes how disputes are resolved, including an arbitration agreement and class-action waiver. Please review it carefully.

1. Eligibility and accounts

The Service is not available to users under 13. If you are between 13 and 18, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

You must provide accurate, current information and keep it updated. You are responsible for any activity under your account and for keeping your authentication methods secure. Notify us immediately of any unauthorized use of your account.

2. The Service is a carrier passthrough

Ship AI is a software interface that helps you generate shipping labels. The actual carriage, tracking, delivery, and any insurance of your shipment is provided by third-party carriers. Ship AI is not a carrier. Carrier terms govern the physical handling and delivery of your package, and any claim for lost, damaged, or delayed shipments is between you and the carrier or its designated insurer. Any included or additional coverage shown in the app is provided and administered by third parties; Ship AI does not underwrite, guarantee, or assume any obligation for such coverage. Included coverage amounts apply only to services that support it, additional coverage may be added subject to applicable limits, and all claims are the responsibility of the carrier or insurer.

The price you see at purchase is the price you pay.

3. Photos, AI estimates, and accuracy

Ship AI uses AI to estimate the weight, dimensions, and best box for your package based on the photo you submit. These estimates are not guaranteed. If the package is heavier or larger than the estimate, the carrier may charge you an adjustment after pickup, which is billed back to you. You are responsible for confirming the package details before purchasing the label.

4. Label purchases

When you purchase a label, you authorize us to charge your payment method for the displayed amount. Payments are processed by Stripe and may be handled by Apple in the case of in-app purchases through the App Store. Refunds are governed by carrier rules, our void window, and applicable law. Labels generated within the last 24 hours that have not been used can typically be voided through the app. Some carrier services are non-refundable at the carrier's discretion; in those cases the label may be voided but postage is not returned.

5. Subscriptions

Certain features may be offered on a paid subscription basis. Subscriptions purchased through the App Store auto-renew until cancelled in the App Store settings. Cancellation takes effect at the end of the current billing period. Fees are non-refundable except as required by law.

6. Acceptable use

You agree not to:

• Use the Service to ship hazardous, illegal, restricted, or counterfeit items, or items prohibited by the carrier's published prohibited-items list.
• Falsify weight, dimensions, contents, or destination.
• Use the Service for fraudulent reshipping schemes.
• Interfere with, scrape, reverse-engineer, or misuse the Service or its supporting infrastructure.
• Bypass rate limits, security protections, or usage controls.
• Violate any applicable law or third-party right.

7. Your content

You retain ownership of the photos, addresses, and other content you submit. You grant Ship AI a worldwide, royalty-free license to host, process, and use that content solely to operate, provide, and improve the Service — including sending it to the third-party carriers, payment processors, and AI providers necessary to generate your shipping label.

8. License

Subject to these Terms, Ship AI grants you a limited, non-transferable, non-exclusive, revocable license to access and use the Service for your own personal or internal business shipping. You may not copy, sell, sublicense, or build a competing service from the Service or its content.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Ship AI disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that AI estimates will be correct. Ship AI is not responsible for, and disclaims all liability for, the acts, omissions, errors, delays, pricing changes, insurance decisions, or insolvency of any third party involved in the carriage, payment, or insurance of your shipment.

10. Limitation of liability

To the maximum extent permitted by law, Ship AI's total liability for all claims arising out of or relating to these Terms or the Service will not exceed the greater of: (a) the amount you paid to Ship AI in the 12 months before the claim; or (b) $100. In no event will Ship AI be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data.

11. Disputes; arbitration; class-action waiver

Except for small-claims and equitable-relief actions, you and Ship AI agree to resolve disputes by binding individual arbitration under the AAA Consumer Arbitration Rules, and you waive your right to a jury trial or to participate in a class action.

Before filing, you agree to first try to resolve the dispute informally by writing to support@tryshipai.com. If not resolved within 60 days, either party may commence arbitration. You may opt out of arbitration within 30 days of first accepting these Terms by writing to support@tryshipai.com with the subject “Arbitration Opt-Out.”

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, applicable law, or risk of harm. You may stop using the Service at any time.

13. Changes to these Terms

We may update these Terms from time to time. We'll update the date below and, for material changes, send notice in-app or by email. Continued use after the updated Terms take effect constitutes acceptance.

14. Miscellaneous

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to Section 11, any permitted court action shall be brought exclusively in the state or federal courts located in Tarrant County, Texas. If any provision is unenforceable, the remainder remains in effect.
